1. Acceptance of Terms

By accessing or using Sfeer ("the Service") at www.sfeerai.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Sfeer is an AI-powered product scene generator that allows users to upload product photographs and atmosphere reference images to generate photorealistic scenes featuring their products. The Service uses artificial intelligence and is provided on an "as-is" basis.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You must be at least 18 years old to use the Service.

4. Credits & Payments

The Service operates on a credit-based system. New users receive 3 free trial credits. Additional credits can be purchased through our pricing page. All payments are processed securely by Stripe.

Credits are non-transferable and non-refundable, except where required by applicable law. We reserve the right to change our pricing at any time, but changes will not affect credits already purchased. Each generation consumes one credit, regardless of the outcome.

5. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable; upload images that infringe on any third party's intellectual property rights; attempt to reverse-engineer, decompile, or extract the underlying AI models; use automated tools, bots, or scripts to access the Service beyond normal use; circumvent any rate limits, security measures, or access restrictions; resell or redistribute the Service without our written permission; or use the Service in any way that could damage, disable, or impair our infrastructure.

6. Intellectual Property

Your Content: You retain ownership of the product images and atmosphere images you upload. By uploading content, you grant Sfeer a worldwide, non-exclusive, royalty-free license to use, store, and process your uploaded images for the purpose of providing the Service and improving our AI models.

Generated Output: You own the generated images created through the Service and may use them for commercial purposes, including e-commerce listings, marketing materials, and social media.

Our Service: The Sfeer name, logo, website design, and underlying technology are owned by Sfeer and protected by intellectual property laws.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate images. Results may vary and are not guaranteed to be perfectly accurate, photorealistic, or suitable for any particular purpose. We do not guarantee that generated images will faithfully represent your products. You are responsible for reviewing all generated content before using it commercially.

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or due to circumstances beyond our control. We are not liable for any losses resulting from Service downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Sfeer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you have paid to Sfeer in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited upon termination for violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
